I am claiming back off HSBC. I have an o/d of 1500.
If I close my account, will they be forced to pay me my money by cheque if I win?
I realise they may issue a final demand for the overdraft, but I will go to the courts to ask to pay it back gradually.

Do you expect anyone to be sympathetic? HSBC will have a right to set off anything they owe you against your debt.
Meet your debt and do not try and "pay it back gradually". This site is about moneysaving, not debt evasion.0 -
I am sympathetic to the fact that you would like your money back in your hand since it was yours in the first place to spend exactly as you wished and it was taken from you, forcefully in effect, over and above any written agreement to repay the overdraft. If you can successfully challenge the bank on this then good luck to you.
