Dear Mr Boss and Mrs Boss
I have now received a copy of my P45, but unfortunately there is a mistake on it.
It states my leaving date as 13th March 2007, but this was the date that I handed my notice in, making the date of my leaving (the company) 20th March 2007. The fact that you did not require me/[STRIKE]I was not required[/STRIKE] to work during this notice period is irrelevant as I was still employed by [STRIKE]working for [/STRIKE]you during this period, and am [STRIKE]still[/STRIKE] entitled to payment for this period.
Also, during the period 21st August 2006 – 20th March 2007, I was entitled to 11 days holiday, I took 8 days holiday ( I enclose a copy of my holiday record sheet) leaving three days holiday due to be paid.
I have been paid up to and including 15th March 2007, meaning that I am still due eight (?) [STRIKE]six[/STRIKE] days pay up to the ending of my employment.
Please could you arrange to forward my final 8 (?) [STRIKE]6[/STRIKE] days pay, an updated P45, and my payslips for the period up to 15th March and for the final pay as soon as possible.0 -
If you took a copy of a blank contract that said one month's notice, personally I think you should be pushing for one month's money. If she's being arsey with you, why should you do her any favours? If it comes to legal action and you can produce that photocopy the court may well look favourably on it, they don't really appreciate big bully bosses
Incidentally legal action is quite easy now, using Money Claim Online...Thanks to all who post constructively.

Remember, they are required by law to give you written particulars of employment - which includes holiday entitlement and notice requirements. They don't appear to have done this - unless the "blank contract" mentioned above counts. (I hadn't noted your reference to the blank contract until it was mentioned by Roger.)
You don't have to sign a contract for the contract to exist - you have been working and they have been paying.0 -
Last Wednesday I hand delivered the following through the letter box of the office. As yet, no response.
There is a law firm a few minutes walk from my current office that does a free 30 min walk in appointment. I think I might pop in there tomorrow.

check your home insurance for legal cover. If you have you may be as well to seek legal advice via this route. I did and won my case. You are entitled to have a pay statement by law. I think the notice period coudl be argued as to a month or a week, but you are definitely due some.
You may also argue for unlawful deduction of wages for the non-payment of holiday pay.

Hi Sue; You're working for a firm of Accountants? (you mad impetuous child!!!) I'd find an approachable, qualified, partner, and ask him to give you a hand. After all; he needs that tax information as well. If you were my new employee, I'd take the P45, and write a nice firm letter to your ex-employers on the subject of how they seem to have omitted some information, and as they probably don't want the pleasure of an investigation by HMR&C, could they complete it properly, and return it again; and to make sure they included all payments, including those for your statutory notice period as well. That usually works. Stops your new employer worrying about the flames licking at the edge of your reference if he writes for one, as well!
Or you could always nail the beach with the small claims court!

I would also be asking about this "unpaid saturdays"
My understanding is that unpaid isnt legal and at the bare minimum they should be paying you the minimum wage.
Im not too sure on this, as theres not much info on it, but why on earth should you work and not get paid for itNOT LEGAL where I come from. ( unless you are volunteering which of course is a different kettle of fish altogether iyswim)

I got a cheque in the post today!
6 days wages, minus tax. A payslip to go with the cheque, and a new p45. This one states my leaving date as 20th March, tax code as BR, an X in the box week 1 or month 1, and nothing in the total pay to date box!
I have only done a few P45's this week, but even I know that there should be a figure in the pay to date section. No payslip for 15th march though. I wonder if that got lost in the post?
From what I have learnt this week, I should get a p60 by the end of the month, as I need something to show how much I earnt and how much tax I paid last week.
I can just imagine what she was saying when she wrote out this cheque. I am so glad I didn't just let it go.

I'm not sure you will get a P60, as they only have to be issued to employees with the company at the end of the tax year, which you weren't. But AFAIK you are right on all other counts ...Signature removed for peace of mind0
