Extension to redundancy notice

Hi, my husband was given a redundancy notice in September 2012 to terminate his employment in December 2012. So he has been applying for jobs and has just heard today that he has got one to start in the new year. Meanwhile last week he received an extension to his redundancy notice to the end of March.

Obviously this is longer than his notice period so I'm assuming that a counter-notice wouldn't work and he has lost any redundancy pay? I just wanted to check that the experts on here agree - thanks for any help.

    Could there be a connection,, like reference were taken so they are hoping he will resign.

    An extension doesn't count - what counts is whether he was in his statutory notice period already when the offer was made.

    No I think it is all above board. The company really are trying to help out by extending the contract. The extension was arranged about a week before references were taken so there is no conspiracy.

    Thanks - that's very helpful - so the relevant part I think is this:
    "The statutory notice period is determined by counting backwards from the termination date, or if that date has been amended, from the original termination date."

    He is in the period of notice from the original redundancy date (but is not in the period of notice for the new extended date) - so I think he can serve counter notice after all.

    Does the same apply with a withdrawel of the redundancy/notice?
