I'm confused by this thread. Can someone clarify some points for me.
I accept that ebay is not an auction, though I hadn't realised that before. So contract law requires an offer and an acceptance.
With a Buy-it-now I can see that the price quoted could be treated as the invitation to offer. The bid would be the offer and the seller would have to accept, either directly or implicitly.
With the auction-style sale isn't the seller actually offering to sell to the highest bidder (subject to the reserve, if any)? If this were so then the bid would be the acceptance conditional on no higher bid being placed.
If this is not the case then it follows that the seller can sell to any or none of the bidders. Is that right?
What is the point of the reserve? The seller can merely decide not to sell if the price he had in mind is not reached.
