Hi there, this is my first ever post so i apologise for any discrepancies. I also a clown went through insure you motor to be insured by XS direct. I knew the xs was quite steep but the monthly instalments were very low so i thought at the time this was a good option. in 2010 i had an accident where i was driving on a main road at around 30mph when a car undertook me and collided with my car causing a small accident. Knowing my xs was £3000 i said to the other driver i will pay him the damage for his vehicle(<£100, seemed best option). He agreed at time but later on i recieved call from my insurance company saying that a claim was put against me. The other driver i believe was racing a work colleague and had him as a witness stating its my fault and i shot out of a minor road! As i obviously refused liability the case went on for quite a while and in the meantime i contacted XS direct to find out what was going on. The drivers colleague/friend said it was my fault so i was told it wasnt looking good and that was around 6 months after accident had happened. 2 years later with no contact to me from xs direct i received a letter saying the 3rd party case had won and has been paid out £3500 for whiplash and i have to pay £3000 within 14 days! Obviously i havent that kind of money otherwise i wouldnt have gone with them in the first place but i contacted them informing this and i am not currently working and in receipt of benefits so there is zero chance of me being able to pay this. I have set up a payment plan of £20/month and said i would increase when either i get a job or when i have more money available. I am stuck tho because i cant get insured now because my current policy got cancelled because of non payment of excess and no underwriters will even insure me now! Any1 with any suggestion/advice/next steps? Any1 know if the statute limitations act means after 6 years i wont have to pay anything? Can i take them to court?(for free) Do i have to pay them? there in N.I.! i would be really really grateful for any 1 to please help me. Thats 6 years after the last payment. And 6 years worth of endless phone calls and constant letters.
If you find work they can get an order against your wages. Wont that look good to a new employer.
Also the issue of insurance.
Debt collectors sees you in a car. They will put 2+2 and get 10. You can afford to drive you can afford to pay them.
So the chances of them taking you to court would be fairly high.
If your willing to live in a box with no posessions for 6 years???
The longer it goes on the lower down the debt collection chain it goes. Until you get the companies that see the law as something to skirt around.
If this is linked to injury that maybe different also.. That might never go away.

Normally this is correct. However XS Direct's cheap rates stem from the fact that their excess applies to third party claims in addition to claims for the client's own loss or damage. Some non-standard risks through brokers will also carry third party excesses.

They are not becoming popular. Kyle777 knew exactly what they were agreeing to but clearly hoped they wouldn't have to claim as they don't have £3k spare.

Like a clown i took out car insurance with one call which had a £3000 excess. At the time tbh i was paying more attention to the monthly payments and based on that i took it out.
As you may have guess this policy was brokered to xs direct. I had an accident in May which I thought at the time was not serious as it was a light hit in traffic and i came off with nothing more than a broken numberplate. I've found out now that the other car has been written off. I hit the other cars tow bar which somehow buckled the structure of the car so the excess is due.
The only problem is they want me to pay within 14 days, with interest being charged daily with immediate affect. So i guess interest has been accumulated already for the past few days. My problem is they are refusing to negotiate a payment plan and are ready to cancel my policy and get debt collectors involved. I don't know how they expect me to pay at a moments notice.
Anybody been in a similar situation? Suggestions in regards to what possible steps i should take would be greatly appreciated.. Im going to get back on the phone to them.
