    Hi

Now the bailiff has listed the good in your house, he can come back any time he wants - those goods belong to him effectively.

The visit fee sounds wrong but you need to be careful given the above.

Exactly what is listed on ths levy?

How many people in the household?

But he can only enter if I allow him right?

He listed my dining room table & chairs, wardrobe, tumble dryer, 1 x sofa, tv and microwave.

    I live on my own.

How much was the liability order for in the first place?

What is the value of the items above (posh dining room set or got it off freecycle)?

    No.

Once he's made "peaceful entry" once, he can return without your permission.

That's what I was alluding to.

By allowing him in, for whatever reason (even to use the telephone, toilet, out of the rain etc.), you have given him the right to re-enter at any time.

My council tax bill was £845.98. The default notice from the bailiffs says I owe them £980.98 even though I have paid £190 so far.

The items all together probably dont even amount to £500. The dining room set is neary 18 years old. (was probably posh in its day)

So he can break down my door?

    Thanks

That is what we needed to know.

OK, the value of the goods in the levy has to be sufficient to cover the debt when the goods are sold at auction. So we are looking at £8-9000 of value in the items on the levy.

    Do you have a car???

You need to pm hallowitch as she has the letter you need to use to render the levy invalid. That will also reduce the fees owed.

In the mean-time pay anything else you can direct to the Council, via their web-site if possible

Some of that may be excluded from the things he can take.

He cannot take anything that is basic to your needs.

For example, he cannot take your cooker so, if the microwave is your only means of cooking, he can't take it.

He must also leave enough seats for all residents to have a seat to sit on.

He cannot take clothes, your fridge/freezer, etc.

If that is your only TV, he can't take it.

He cannot take anything that doesn't belong to you (but it is up to you to prove it belongs to someone else), nor anything hired/rented or on HP.

Also, he cannot seize any tools, equipment or vehicles used by you in your employment.

he can attend with a locksmith, but you can stop this if you get the levy overturned.

Ok I will pm hallowitch and I will make a payment to the council. I'm sure I have read somewhere that once the bailiffs have taken over you no longer have the right to pay the creditor??
