Problem with LloydsTSB

I have tried claiming charges on behalf of a friend with LloydsTSB in my original letter I put in a paragraph stating "I request without further notice a breakdown and proof of all costs involved, in regards to your actual or liquidated losses involved in any breach of contract to which these charges relate with yourselves, and that these charges reflect your true costs in relation to the said charges, and are proportionate to the charges levied on my account as defined in Unfair Terms in Consumer Contracts Regulations 1999. Schedule 2 (e)"
they replied with "The office of fair trading has published new guidelines on credit card default charges. The important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This does not apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not defult charges because you haven't broken your agreement.They are our prices for the service we provide in these situations"
So I'm a little confused on how to reply to this any help would be greatly appreciated

Just take the second template letter from Martin's article, giving them 7 days to pay the money back - after that, file a claim. Lenghty discussion with the banks are time-consuming and futile.Reclaimed thanks to this site:

we got the same letter last thursday and i sent them the 7 days letter, and i will be starting procedings if i dont hear owt tomorrow0

An update - I have just been made aware that Martin has changed the second letter template to 14 days instead of 7 days.Reclaimed thanks to this site:

tHAT IS A BOG STANDARD LETTER, that lloyds send to everyone to confuse them and put them off, but it is a tactic recognized by the courts and is known as "cloaking Penalties" by doing this their are in effect doing more damage than good ,as we can argue that cloaking is in effect a concealment and that by doing this they are no longer protected by the Limitations Act, which means that we can then claim for 12 years. This is the reason that they always pay up before the court date. Hope this helps!0
