  • If you don't need a hire car, then you CANNOT and SHOULD not use the services of Drive Assist as you will be asked to sign a statement of truth saying that you need to hire a replacement vehicle.

    You have a duty to mitigate your losses, so don't incur hire charges if you don't need too. If you lie about the need for a hire vehicle, then Drive Assist may rightfully seek to recover the costs from you if they are not settled by the other party.

    Neither your insurance company nor Drive Assist are obliged to pay for the repair to your car as you are only third party insured. Neither are the other party's insurer if they can prove they were not negligible for the accident.

    I think you have two choices, pay for the repair and try to reclaim the cost from the other party's insurer or wait until they accept liability and ask them to arrange the repair of your car.

    Really sorry but your options are limited.

    When I spoke to Drive Assist I did tell them I didn't require a hire car which was true this week as I have been on annual leave from work. I have been able to manage without a car during this time by walking/public transport/lifts and just wanted to get my car repaired with no hassle. I am back at work next week so ideally need a car to get there so I would not be lying to them if I reinstate my claim. I don't see why I should be getting two buses to work because of somebody else's mistake.

    In which case you do have a need for a replacement vehicle and you are within your rights to use the services of Drive Assist.

    They will try and get you to take out CDW cover (£4 a day) but this may be capped at £50 or something.

    You may also have the option of paying nothing and only paying an excess if the car goes back damaged. This excess should be a maximum of your own insurance policy excess but may be less.

    If the car is scratched or stone chipped the cost of repair is often less than £50 anyway, so i would personally risk the excess option but its up to you.

    With regards to the £10 cover to protect from having to pay hire car charges if they are irrecoverable, check this with Drive Assist, but my guess is that this is thrown in for free as part of the arrangement with your insurance company for referring the case to them. The £10 only usually applies when you approach them direct or via a small insurance broker or repairer.
