Highview Parking

Please don't shout at me. I have read the forums and the POPLA information. I just want to be sure...

I received a Charge Notice from Highview Parking about parking in Leeds. They have pictures of me entering and leaving and the times shown do indicate that I was over the time ... by 1 minute! (4hrs paid for, 4hrs 1 minute between arrival and leaving). Of course I spent a couple of minutes on arrival finding somewhere to park and then parking; So yes I was over the limit, but not I wasn't actually parked for longer.

They want £75 for that minute (rising to £95 and the £135 after 28 days). Given it is so obviously unreasonable am I still best ignoring it, or would a letter likely result in them saying 'forget it'?

I rang RAC who said "can't advise you to ignore it but they may be unlikely to come after you".

I rang POPLA who said they could not offer advice (including whether 1 minute out of time paid for was grounds for appeal or not)

For people (like me) used to paying their dues and accepting fines where they are legal this new legislation does not seem that much help

    Ignore it.

    Quite apart from the fact that it is unenforceable due to their lack of authority to offer a parking contract to a driver, and the fact that their losses were zero, driving around for a minute or two to find a space is NOT being parked.

    In all probability you were 'parked' for less than 4 hours anyway.

    As long as this isn't a hire or lease car and you know the registered keeper, ignore it all.

  • You are perfectly safe. There is no way you could possibly be held liable for such a charge in those circumstances.

    You could appeal on the basis you stated, that you were not "parked" for more than 4 hours. If their "evidence" is ANPR of you arriving and leaving, then that is not evidence of how long you were parked. Then, when rejected, you can cost them £27+VAT to appeal to POPLA, where you can add all sorts of more robust arguments to scupper them.

    You can safely ignore it but if you have time then I would appeal it, first to the PPC in writing and then to POPLA.

    This is a ridiculous allegation seeing as you cannot have been parked over the 4 hrs. Stop phoning people though, never phone up about any kind of parking ticket. You need a paper trail even if just by email.

    The point of advocating a POPLA appeal here is threefold, first to cost the PPC money and secondly to probably get it cancelled when they realise you know what you are talking about. If not, then thirdly, this will be a terrific example for POPLA to see how PPCs operate!

    There's no risk to you by appealing as POPLA isn't binding on you and you can then revert to 'ignore mode' if POPLA are daft enough to find the ticket OK! :p

    I'd appeal with something like:



    Dear Highview,

    Re: Invoice number xxxxxxx Impersonating a Parking Ticket

    It appears that you are of the opinion that I might owe you an extortionate amount of money for the minute it took me to drive into the car park in Leeds, find a space and park, then later, drive out.

    I beg to differ but if you must persist with this drivel then let's see what POPLA say, shall we?

    I request that you cancel this 'invoice' in writing to me within the next 35 days after service of this letter/email.

    Should you decide not to cancel, I require a Verification Code in order to refer it to POPLA, incurring a charge to you of £27 + VAT. As you are well aware this amount is not recoverable from me, and their adjudication, if sought, would be binding on you but not on me.

    In addition, any of the usual debt collector letters will be ignored and any 'admin fees' added, will be null and void. If you think you have a case here then you have a duty to mitigate your alleged 'losses' and so I suggest you take it straight to County Court within 14 days of the POPLA decision - if they do not uphold my appeal.

    In the event that you wish to proceed to County Court, please be aware that I will defend against your action and will also raise with the BPA and the DVLA, several breaches of the Code of Practice which are apparent from this incident.

    I would add a little extra to that reminding them that any further actions and./or demands for money with threats from debt collectors, threats of CCJs, balifs etc will be taken as harrasment, and legal action may be taken against Highview parking and <NAME OF CAR PARK OWNER> for whom you hold jointly liable .

    It says I havent paid at all but my bank statement proves i paid for 24hours! (5th Nov)

    Found another thread about this today so look like there as a few errors with this carpark.
