Badly scratched CD from Ebay

Maybe it is a hard way to learn a lesson buying from Ebay, but the CD was described as
"Excellent condition and no scratches", so i bid for it and won it.
CD arrived. Box in good condition, Label side pristine condition, but alas the mirror side of the disc is so badly scratched.
Giving it the benefit of the doubt, i played disc in 3 different players, but the disc is unplayable.
What would you do?
Have contacted seller,but no response yet. Do not suppose there'll be any response.
A real pain!!! And one very disappointed 8 1/2 yr old DD.
Paid via Paypal within minutes of winning the bidding, so i did everything correctly.
There is NO way i scratched the CD. Suppose most people would just give up and put it down to experience. WHAT WOULD YOU DO?

sounds like a clear cut case of item not as described and therefore would reccomend a dispute. have you left feedback yet? if not negative needs to be left to notify other buyers of this person

I think the usual ebay etiquette is to allow the seller to try and rectify the situation before just charging in and leaving bad feedback, before they've had the chance to do anything...

When did you contact the seller re: CD?

Contacted seller immediately after establishing that the CD definately was unplayable.
Contacted seller via personal email address, but this is sending back a failed delivery notification.
Have now sent an email to seller via Ebay's 'Ask seller a question', as they have a t-shirt listed for sale and this was my only way of communicating.
Have not left feedback as yet.
