help with esa85 Medical Report

Hi,

I have finally recieved the notes from the wca and not really sure what its telling me. Should it give me a note of points or something.

There are some bits that have been misrepresented and some other bits missed out that I said but I don't think its as bad as I expected or that good.

    The ESA85 medical report I presume you have got. It should go through the 17 sections regarding the WRAG descriptors... in many it may say 'none of the above apply' or something like that... but if a descriptor was found to apply then it should be stated. You can determine the points from comparison with the link I'll give below. After the 17 sections for WRAG then the report should state whether support group descriptor(s) were met and indeed then give prognosis. The prognosis will likely be used for reassessment timing should that be applicable.

    From the report you'll know what group is recommended by ATOS, if any. It is likely the DWP will accept the ATOS advice and take decision in accordance with it within the next few weeks.

    on further inspection the report is pile of rubbish :( Which goes to show how much my ability to take in and understand information is stuffed.

    I got no points and should be fit for work in 3 months. :mad:

    Most of the reasons given to why I didn't qualify for some of the outcomes was because I looked ok. I suppose I should have gone in my pjs reeking of booze and that would have helped. So angry now. I don't want to be not working but in the same breath I not well enough mentally or physically at the moe hopefully it will improve. It was the disability person at the job centre who told me to apply for ESA as I wasn't fit for work.

    The DWP have had the report since the 1st of October and done nothing with it do I have to wait untill I am officially told that I not qualified before I do anything. There are several inacuracies in the report including that I bought a car, regulary see friends and on one page it says I walked fine on another I struggled to walk and then in the summary I walked at a very very slow pace.

    You could try to whip up a letter to DWP decision maker stating the errors in the report and saying which descriptors they should have found to apply... it may deter them from using the report... it's a long shot that I've seen reported to work in a few cases... although if you could get medical opinion to agree with you perhaps not so long. The alternative is appealling when the decision is made as is standard process. Now might be a good time to think about possiiblities of supporting evidence in view of what decision is likely. Long term you may wish to make complaint to ATOS and the ATOC HCP's regulatory body regarding the report.

    You should be able to get assessment rate ESA while appealling.. if you can get sicknotes to cover you.

    Yeah GP is good. The closer you can get an opinion that currently you meet descriptors x, y.. and why.. the better. It's a game of evidence. Tribunals in particular are going to be particularly persuadable by GP evidence... there's a chance the panel will have a GP on it..lol. But the sooner into the process the better. All focus on the descriptors... medical evidence that is generally supportive of claimed problems and illnesses can't do any harm... but descriptor related information or opinion could be highly useful.

    I would expect the DWP decision at any time.. to be honest I'm surprised they haven't delivered it yet given it is likely negative... 2 months and counting.
