  • so many replies so quickly! thanks everyone. i will wait another 24 hours to see what other people say but i am inclined to think that paying may end up being the only way to avoid criminal proceedings.

    What really frustrates me is the fact that there was no ticket on my windscreen when i got back to the car. Naturally suspicious, I ponder whether it was stuck there for the photographic evidence and then removed so that I would miss the 28 days timeout.

    I have added the photo evidence to the dropbox folder.

    Or maybe it just blew away !!!

    You call it 'another PCS Parking Invoice' and yet the sign seems to be a CP Plus one from the logo on the top right.

    We haven't seen this invoice, so who is it from, this follow up letter? If from CP Plus or PCS (private firm) then certainly IGNORE IT. They and NCP often frequent railway car parks but they DON'T issue real penalties and don't act under bylaws. We have NEVER seen a real one issued by a PPC.

    Although the sign says 'penalty' I would suggest that the actual ticket was likely to have been a rubbish impersonation, a Parking Charge. Ask for a copy of the 'ticket' so you can consider your position, and ask for the bylaw/statute under which this was issued, or clarification as to whether it was a contractual allegation. Specifically ask, as I never saw any ticket on my car, was this a Penalty Charge Notice or a Parking Charge Notice?

    If the letter is from the TOC (Train Operator) themselves then I would suggest posting about it on pepipoo for help, as those are the only ones occasionally followed up with a case at Magistrates' Court.

    So let's see the follow up letter please (cover your details & date/location).

    Good news you can IGNORE them completely.

    This is a Parking Charge Notice (their description)

    They also mention POFA which has nothing to do with Byelaw 14. and everything to do with PaArking Charges

    The letter does not mention Byelaw 14 at all..it is just an INVOICE not a real Penalty ticket !!

    FORGET EVERYTHING discussed here re Byelaw 14 and Criminal Proceedings this is an unenforceable Parking Charge .

    IGNORE IGNORE IGNORE.

    If you get a follow up from the TOC themselves threatening Byelaw 14 action then come back for advice.

    So a fake ticket issued but all the Notices are about Byelaw 14 ..so why are they not issuing real B/L 14 tickets ..if their business model is not to do so then those Notices are tantamount to deception and worthy of a complaint IMO.

    Still possible that they could clamp or tow next time ...but they can not clamp/tow to secure payment of their unpaid invoice as NCP has just found out in court to the cost of £2800+.:rotfl:

    PS That yellow black check envelope mimicking statutory tickets issued by Councils and Police is also a no no ..!!
