NRAM - Not accepting voluntary repossession

Hi

My partner and I moved into rented accommodation on 1st November and went bankrupt on 9th November.

We have vacated our mortgaged property and contacted NRAM with regards to what they wanted us to do with the keys etc.

We have shut down all the utilities and contacted the relevant suppliers, we have building insurance until Jan 13 and have contacted the local council re council tax etc.

NRAM initially wrote to us and asked us to sign forms - after reading advice on here a while back we knew not to sign anything as in doing so we may still be liable for any shortfall etc.

Today I have received a letter stating that they are unable to accept my request for voluntary repossession at this time and not contacting them could result in legal action.

Is this normal procedure for NRAM?

I will post the keys back to them today (I had held on to them as they had not advised what to do with them). Is this the right course of action in this case?

  • I have had exactly the same situation this year.
    Vacated in February and went bankrupt in March.
    Wrote to NRAM explaining we wish to voluntarily give up possession of the property and the we had moved, also included the keys. Sent recorded delivery.

    They would not accept the letter and said they would only accept voluntary surrender if I signed their letter; for the same reasons as yourself I refused to do this.

    They kept contacting me throughout the year until it finally went to court in October; they are taking possession next month.

    All they seem to have done is delay something that they could have done 9 months ago.

    Just keep re-iterating that you are no longer in the property and that you will not sign their letter. And don't let it upset you when you keep having to repeat yourself.

    In the end all you want is for them to take possession sell the house and let the bankruptcy take care of it.

    I can only assume that they delay so much as they continue to charge for each month a payment is not met - which will then increase the amount due to them when the house is sold.

    Just when I think I am beginning to cope with it all something else happens!

    I will send the keys back tonight and ignore all other requests.

    Typical of NRAM I'm afraid. They seem determined in most cases to shoot themselves in the foot and cost themselves more in the long run by going via the courts.

    You can see why they got themselves into bother in 2008.

  • I sent my keys back to nram after I had vacated the property. They didn't know my forwarding address so I heard no more, however I did phone them a few times and it took around 9/10 months before they took possession. They destroy the keys as soon as received, and once they have been to court for possession they change the locks and put it on the market. Try not to worry, it seems they do things the most costly way possible!

    Yes - they sent us letters every month adding an extra £25 for unpaid direct debit.

    Even though they take possession in a fortnight they still suggested that we pay off all the arrears this week so that we can stay in the property (we moved in Feb!!!).

    One thing I did do when it finally went to court, was that I wrote to the court explaining that we have attempted to voluntarily surrender the property and we would not contest anything.

    They will ring you (a lot) so if you can recognise the number best bet is to ignore as you will be saying the same thing to somebody else. The departments don't seem to be tied up.
    And unfortunately the call centre people don't know what they are calling you for until after you have been through the security checks - so it's not really their fault.

    I will just try to ignore all future phone calls/letters and let them do what they feel they need to do.

    I like that you wrote to the court once the date was agreed, I will do the same.

    Same circumstances for me.

    Moved out of NRAM mortgaged property into privately rented a week before BR.

    All I did was send the keys back stating I no longer lived there, would not be returning and that I could not make any payments due to BR.

    I didn't mention anything about repossession - I just let things take their natural course.

    NRAM did write back to say they'd destroyed the keys and I had one or two letters from them, but nothing worrying.

    They eventually started repo action 9 months after I moved out and it was actually repo'd a year later, at which time the shortfall fell into my BR.

    I didn't sign anything, or complete any court forms or attend court myself.

    What's NRAM? Sorry to be ignorant. O.P. I don't understand why they are refusing, unless it's as someone says; that they're trying to delay it with the hope of getting more money.

    But yes, what is NRAM? Anybody? :)
