How can this keep happening?

Unpaid item case opened against a buyer who was given 14 days to pay before i closed it as they had paypal problems apparently.
It was closed roughly 5 days ago, now they have been able to leave me a neg fb and trash my stars wrecking my rating until ebay shift it!
I thought the system was meant to stop non payers from being able to do this.
This isn't the first time either.
Oh anyone know how long it is currently taking them to remove them? Can't ring them so have emailed and used the report a buyer function.
