Second consultation..competitor job offer

Hello all hope someone can offer advice.

I had my second redundancy consultation last Friday and was given a letter stating my redundancy calculation and date of termination been 21/12/11.

In the meantime I've been offered a job with what could be perceived as a competitor where they want me to start early next year.

My question is if I tell my current employee now could they bring my termination date forward but would they be liable to pay me until 21/12 if I say I am willing to work or are they within there rights to bring date forward and then give me a months notice? The only thing I can find in my current contract / company handbook is with regard to 'gardening leave'.

The letter does state 'official documentation will be given if notice of redundancy is served'.

    There is the risk they scupper the job offer or withdraw the redundancy if you let them know.

    What have the done in the past have they negotiated put people on garden leave etc.

    Depends on the job many just put people on garden leave.

    How long have you been there

    If they have not actualy issued termination due to redundancy notice yet then you can't use counter notice.


    Since the proposed start date is after you are due to leave without more info keep quiet(don't even tell you mates).

    In the past I believe they have put people on gardening leave but need to look into it.

    I've been there just over 2 years.

    Appears to be a difficult situation. As you say best to keep it quiet.

    Hi,

    But in reality, how much redundancy will you get - it is only 2 weeks & capped at that?

    My attitude is don't say a word - just leave - I also don't see how they can stop you working for a direct competitor when they are getting rid of you?
