Do I have to pay Littlewoods for item not sent?

Hi all,

I ordered a halloween outfit and wig from Littlewoods 5 weeks ago.

The wig arrived but the outfit was crossed out on the delivery note saying sorry they had sold out and could not provide me with one and that they would arrange a credit. I didn't get one.

I phoned Littlewoods who said I had to wait 12 days to claim for a missing item and to ring back once the 12 days was up.
I pointed out that the item wasn't missing, it was not sent in the first place but they said I still had to wait 12 days!

12 days later I e-mailled (so I had proof) asked for my credit. I was now told that It wasn't actually Littlewoods who were supplying it, they had forwarded my order to a third party and the third party were showing the item as despatched.

I left it a few days and still no item or credit so i contacted again and this time was told my case had been forwarded to "a specialist team for investigation" I replied saying I have proof the item was not sent, i was told they would credit me.... why does it need investigating? I sent a scan of the the delivery note stating this but now they are quibbling that the message to me was written in pen and not printed on the delivery note. I pointed out that the delivery note was printed by Littlewoods and not the third party supplier so how was the supplier supposed to alter the note if they haven't access to Littlewoods system? But they are not being any help.

Where do I stand if I just refuse to pay for the item? Can they make me pay?
I'd appreciate any help.
thanks

Sorry, but have you paid for the goods yet, or is this a credit account?
The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark
  • its a credit account, i haven't paid yet
