Cut off time?

Hi guys, I have a quick question that I cannot find the answer to anywhere else (google and eBay)

My son (grown adult but a student) used my eBay to buy a second hand Nintendo DS about 2 months ago. He came to me today  and asked me if it ever got delivered. It didn't but I told him I don't think he can do anything about it as its been so long. So my question is, is there a cut off time where he can do anything about it or is he far too late.

I don't fancy contacting the buyer after 2 months, especially if I don't have a leg to stand on.
