Car Warranty Dispute - wear & tear

I'm just so annoyed it went so soon after buying the bloody car. I know the reason, the car was remapped and I never knew when I bought it.
I have proof of it because the fuel consumption was so bad I took it to a place to remap it for better fuel economy.
Basically, I bought a lemon.
i doubt you bought a lemon because a wear item has now worn.
the map, well without knowing what the previous owner specified, hey/she may well have requested a performance map only. then you will get bad fuel econemy, as its mapped do your insurers know?
and could very well be a good excuse for the warrenty company to refuse to touch the car as its not standard anymore.0 -
Decat on mine and a remap. MPG has improved.
It has the potential to use more. But driving the same its improved..High 30's mpg towing thats a shock.
Very low 30's before.Censorship Reigns Supreme in Troll City...0 -

What?
Remaps don't automatically cause DMF failure, my Rover 75 with 200k on the clock had one for a good while and I used the power regularly - around 190bhp up from 135.
I also fail to see how a failed DMF makes a car a lemon. If that's a bill that makes you think that, I'd buy a bike - it could throw many more your way.0 -
The warranty came with the car when I bought it. I just wonder if anyone knows of any engineers I could send it to, who can cut it open and provide a report. Clearly that will cost me, but it's an option to explore.
I can't see anywhere you state what the mileage of the car is. This would have a bearing on the wear and tear which could be expected.0 -
Sorry, the millage was 83k when it went.
A remap increased the BHP to 185, instead of 140. Hence more stress on those parts. I never realised this when I bought the car, or wouldn't have bought it.
I did try to get it remapped (who then told me it was already remapped) but said the person who did it before has locked the ECU, so nothing can be changed back. They did however offer to turn the boost back down, so it's equivalent to stock BHP now.
The previous problems I have had is with oil leaks, the car went back to the dealer four times to get fixed... and they couldn't fix it (kept changing stuff but didn't want to get the whole engine out to find the leak). Then messed around for so long it passed three months (Sale of goods act so then couldn't return it) so paid for the car to be fixed myself. That cost me £300.
I put that £300 (plus another £200 for a service) down to life experience, but now with another £600 bill I'm pee'd off.
I will write back to the warranty asking how they know it is wear & tear, that will only cost me a letter. But I don't think I'll get anything.
I don't know if it's worth going back to the dealer, but have I got a case against them? I wish the DMF went within the first 3months.0 -
Another option to explore is to question the Warranty company about why they say wear and tear. If it hasn't been opened to examine then they can't back up their position.

its easy to tell on visual examination when properly trained to do so that wear and tear or a defect caused a failure to clutch or DMF.
EDIT: they also cannot tamper or destroy it or dispose of because they HAVE to give it back for YOU to decide whether to fit it back in there to have the car back from the garage.0 -
Well I bought a Ford Protect warranty to cover my 95k, 6 yr old Mondeo TDCi last November. Last week, the car failed to start. It needed a new starter motor, DMF and clutch. Car has now done 113k miles and Ford warranty has paid for the DMF and the starter motor. They didn't quibble, they said that the warranty covered DMF and that was that.
This is the first time I've ever taken out an extended warranty, normally I'm really sceptical about them, but I'm pleased I did.
If the warranty says it is a covered item, they should honour it!0 -
unless its wear and tear which is pretty much ever failure
a remap wont cause a dual mass flywheel to fail the flywheel only spins and the way it works is to lessen the vibrations from the engine/transmission
the main component that remaps can give an early grave to is clutchs as the origional clutch wouldnt have been designed/spec'd to handle the extra torque that is made some maps have increased torque over 40% more0 -
TBH, a buying a warrantly for a 6 year old car that excludes 'fair wear and tear' sounds like a waste of money."You were only supposed to blow the bl**dy doors off!!"0
