Divorce form E. lies

Good morning all.
I won't bore you all with everything but a long story short.
My boyfriend is getting divorced from his wife, been seperated along time, finally found her. (I am not the cause of divorce by the way) marriage just broke down.
Anyway, they have both had to complete a form E as she took the profits and was supposed to clear loans with the profit and she could keep the rest as he wanted a fresh clean start and no hassel. There are emails confirming this but she never followed it up anyway, the loan has grown and he is claiming for half the profit now to clear the debt as the bank has also agreed to clear it if he wins. BUT on her form E she has lied throughout about her financies, lied about that he didn't work etc.... But after some patient investigation work we now have all the bank statements for that account which shows she has lied throughout.
What I want to know is. Does the judge read the form E at all and put two and two together and come up with 4 or does he/she just going to look at the basic info and say poor poor you. Anyone had experience with this????
We can't afford a solicitor at the moment, and I'm asking for advice everywhere but losing hope here.

  • If you got access to her bank statements, then i assume it was court ordered? as I dont really know of any other legal route to get them. If it was court ordered then there should not be any problems

    What profits? Was there a business involved?

    Were the loans joint (or business loans?)

    What acount do you have bank statements for? His/hers/joint/business?

    A Form E is a sworn statement of the true facts of the case. There is a disclaimer that in the event that you lie on the form or deliberately withold and mislead with information, that is a serious offence.

    The Judge can impose struct penalties, but in reality divorces are Civil Courts and unless the lies are so damn blatant then it's unlikely she will spend some time in prison.

    Classic example of this is the high cost divorce case of the Young's. It has been in all the national newspapers and at present is back at the High Court. The Judge in the case has given Mr Young a set amount of time to come clean about his finances if not the Judge will send him to prison. Now this case has rumbled on for quite a few years and the costs are considerable.

    It will be down to your partners solicitor to make the Judge very well aware of the extent of the lies and defamation in the Form E and take it from there.
