Insurance chasing B-in law for an accident over a year Ago

    the other drivers insurer would pay for the car repairs (if she was fully comp) but not for the injuries

    Good point, their insurer will only pay for what's covere under the policy, not for the uninsured losses including the injuries.
    As this is likely to go to the MIB once the other side realise there was no insurance I'd have thought they would do any scrutiny required

    Sounds like it's best to not negotiate and let it go to the MIB as they will (hopefully) only payout what is correct.

    So what response do you recommend? Informing them he's uninsured and leaving it at that? After all he does not want to accept liability even though it looks very likely he's liable.

    I wonder if it has gone to the MIB already. I am well out of date but don't the MIB nominate an insurer to deal with uninsured driver claims?

    Could it be the MIB (or nominated insurer) rather than the TP insurer pursuing now.

    I have a feeling there has been more than one letter since the accident happened.

    Don't know, the OP doesn't mention more than one letter and I wouldn't have thought that liability & quantum could be decided without the knowledge of the OP's BiL

    Wouldn't her insurance would pay for TP passenger injuries regardless of whether she was fully comp or third party - surely it would only be her own personal injury that wasn't covered and she could have had another policy - medical for instance - that paid some of the costs.

    I'd have thought her insurance company would only pay for passenger injuries if she was liable. As she was not at fault I'd say there was no liability so all injured parties would claim against the at fault party

    Thank you everyone for your advice and apologies for not replying. but due to the distance from where i live and BIL lives i have been very limited to the info i have had hence the vague description. but after travelling up to him over the weekend and seeing the letter myself i have more of better of idea what this is.

    Luckily it is civil case and not a criminal case which is relief. and the TP has rather than then insurers has got PI solicitors to front up their case for PI for the amount of 25k. which they want BIL to pay and want proceeding to take this to court. as mentioned BIL will not be able to pay this regardless but as lisyloo mentioned the oprions of deductions from pay and maybe if found guilty to have this amount attached to his house are maybe the only option. But as i do not think he will sell the house as he does need to live somewhere the only thing i can see is COURT put him on a payment plan but i think he can only pay about £10-20 at most

    any ideas what other things court may if found guilty put on him to pay this?
