Last few posts are constructive thanks - in looking at fairness it is worth pointing out that this was not a case of wont pay - I lost my job - couldn't pay - fully engaged with creditor - they even said they would not register default without checking to see if my circumstances had changed - they did not!!!!! But registered a default with issuing a default notice0

But you said that had you known about the default you would have cashed a policy in to pay it. You had a debt, you didn't cash a policy in to pay it when you lost your job, and the FOS cannot see that you had the means to pay, evidently taking the view that you would have paid already had you been able to.
Why didn't you pay if you could have done?

If you owed money to a lender and you didn't comply with your agreement with them, you must have realised that you had defaulted on that agreement. Why didn't you contact MBNA if you weren't able to pay ?
Whether a default notice is issued or not, you've still defaulted. I can't see why you would think it should be removed.0 -
IMO it is disputes like this which is strangling the ombudsman service and making it much more difficult for genuine cases to be heard.
I really do think it is time to introduce a fee to go to the ombudsman which would be refunded if you won your case.

Or fee to be refunded if ruled the plaintiff wasn't being vexatious or just taking a punt.... I'd be happy with that
