House flood after exchange of contracts but before completion

Hi Guys,
Sorry it's taken me so long to update!
Here goes....our solicitors have written to their solicitors numerous times now, pretty much 'demanding' that they either provide us with evidence to substantiate their claims or that they repay the deposit. Thy have only replied saying things like ' my client stands by his statement' but producing no evidence. Their solicitor has confirmed that the deposit is still in the solicitors holding account and hasn't been paid to vendor.
We have had confirmation that our insurers will cover the legal costs if and when we take it to court, relieved about that as our hot shot lawyer is very expensive! To finish this update our solicitors have now written another letter to theirs stating that if we have no conformation by 12 Jan( today) that the deposit will be repaid immediately then we will begin legal proceedings for deposited, interest and expenses, ( as well as legal fees). Maybe he will just repay deposit and avoid court as he hasn't got insurance cover!0 -
Hi all,
Well, the deadline of the 12 th Jan has now passed and with no response from Vendors solicitors it looks like we will begin court proceedings.
I'll keep you posted when theres more news.
By the way Jaybeetoo, no-one else was effected regarding breakdown of chain. My daughter had already completed and moved out and here was no onward chain.
Regards.0 -

Good luck with it all0 -
Good luck, I suspect the vendors might fold quite quickly faced with court proceedings. Do keep us updated.0

What a very difficult and stressful time for all involved.
Your daughter is lucky to have you involved. Good luck

Quick update.
We have instructed our solicitors to go ahead with ' legal stuff'! Lucky to have legal cover through insurance. We've been advised it could cost £50 to 60k in costs ( so glad we've got insurance cover!) and could take 9 to 12 months. Patience is a virtue!0 -
Jut another quick update....my daughter and her boyfriend have now signed a CFA with their solicitors . Tomorrow the vendors solicitors should definitely realise that were not 'all talk and no action'!.
Will keep you posted.0 -
