Broken fish tank, what are my rights?

We bought a fish tank in June, paid through paypal for protection.

10 weeks later the tank cracked.

We were out of the paypal time to open a claim, the seller has not been helpful saying it was accidental damage, it could not possibly be, the back of he tank where the crack is was against the wall.

Should a product like this have a warranty or cover? Is there any distance selling regulations for this?

    If the tank was full of water and not on a suitable base it will crack.

    There is no flexibility in glass.
    I used to be indecisive but now I am not sure.
  • The tank and base were purchased together, so the base was suitable.

    It depends on many things as to your rights. If it was new is one, plus lots of other factors come into play, correct use for the right type of fish, water, etc. even the type of floor you have.

    If the seller is not the manufacturer, contact the manufacturer and ask how long they are designed to last and take it from there.

    Your rights with the seller depend on the terms they sold it to you, distance selling regulations don't apply after ten weeks.

    The tank was brand new, it did not have any manufacture details, however I know the seller is not the manufacturer.

    Tank is for tropical fish, which is how we used it.

    We have solid oak floors, all floors were all levelled before the wood was laid.

    If I believed is was in anyway our fault I wouldnt pursue it, I believe the glass cannot be made/ is not suitable. Who would honestly expect to buy a fish tank which cracks 10weeks later.
