Urgent- Help Needed- Hsbc Bank

I am really annoyed..I hope I can get some help on here as I am finding it hard to understand all the info on this webpage..just soo much to take in

Firstly I called my bank today and asked them what my overdraft limit is and they told me I have no overdraft facility on my account.. so why an earth am i getting charged sometimes between £100 and £200 bank for going overdrawn like £80..if i dont have the facility why do they still let me go overdrawn? and they charge £25 everytime a direct debit comes out of my account while I am overdrawn..Am i allowed to reclaim or is it you can only reclaim if you go £2 overdrawn and get charge £30?

and some of you repsonded saying i can definatly claim back so i wrote them a letter and sent it to them via recorded delivery on 16ht MArch which they recived on 19th March. I had to send it to HSBC customer service as that is the only address they supplied....and they still have not repsonded..have a i got a good case..HEL...the letter i wrote to them is below



I am writing to request a fully comprehensive list of all the default charges for direct debit, unauthorized overdrafts and standing orders I have paid over the last six years.

I spoke to an employee when I rang the bank with an account enquiry on Wednesday 14th March 2007 at around 7.20pm. I would be happy to provide proof of this phone call via a BT phone bill, alternatively as you say you record your calls you can also find proof of the phone call. The lady who I spoke to advised me that I don’t have an overdraft facility on my account, again the proof I was told that by an HSBC employee would be in the recorded phone call that you would have recorded. I have been advised that as no overdraft facility exists on this account, you have been unlawfully charging me for using a facility which DOES NOT exist on my account. You have taken advantage of insufficient funds on my account and taken this as an opportunity to charge me ridiculous amounts for an unauthorized overdraft.

I give you permission to debit the above account £10 for providing me with this data. If you are unable to provide this data, I will accept a copy of my statements going back six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law.



If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

I look forward to your response within 40 days, as HSBC is obliged to reply under the Data Protection Act. If not I shall seek remedy from the Information Commissioner.
