seller not responding

Same old problem I think.
I bought an item and a couple of days later received an email (from business seller with shop) to ask had I received the item as they were having trouble with post and could I contact them with any problems before leaving feedback. I replied I had not yet received it but would let them know. The next week I received the item in an opened bag (but not clear plastic post office bag) and the dispatch date was later than notified so I felt the seller had maybe been trying to cover up late dispatch.
The item is clothing which is way out size wise so I contacted the seller advising that I would like to return it - (the buyer accepts returns) - and heard nothing. I then clicked on the returns procedure on ebay and now have 1 case open, waiting for seller to respond. I have still not heard anything. I thought I would simply contact the seller and they would authorise return. It looks like I have opened a case and if I do not receive a response there will be a chance to escalate it later. Is that correct?
I am surprised considering the seller was so keen to avoid any low feedback.

I don't know if this is possible, but can you now open an SNAD claim?
Well Im unsure if I have already done this unwittingly. When I clicked on return and reasons it gave me options and the nearest one was not as described so I ticked that one and then put a message in the message box. This would then be sent to the seller and the ebay staus says waiting for seller response, the next steps state when the seller has approved your return please post asap and then the seller will refund you.

I was just wondering whether it is possible ot now open a full SNAD claim using the 'resolve a problem' drop down menu from the sold page?

It does give me the option to go to the resolution centre so I think I will do this if I do not hear from the seller this week. ThanksSo you're Red John? I have to say I'm a little disappointed.0
