Redundancy Payment not same as quote amount

I've just received my redundancy payment and it's lower than the amount I was quoted with my official notice of redundancy. I'm being offered (slightly!) more than statutory redundancy so I have no idea how the company has calculated it (either time).

Obviously I am going to query it, but if the company comes back with something along the lines of "that's just what it is" - which I expect is what they will do, do I have any legal recourse to insist that they have to pay me the original amount?

    They should provide a breakdown of the payments and how they got them.

    might be able to work it out if you provide the details and salary

    the figures should include redunancy, holiday pay, notice pay as applicable

    Mine will vary slightly from my compromise agreement because of a few days of outstanding leave. Yours might be similar.
  • It's broken down into redundancy payment and outstanding leave. However the redundancy payment itself is lower than the amount set out on the original paperwork I was sent. It's more than statutory redundancy pay, so basically the difference is an ex-gratia amount. I know the company can pay what they like for this, however I'm querying whether they can change their mind between giving me the redundancy quote and actually paying me. It's important as I've made a few key decisions based on the amount I thought I was getting. It's not an insignificant amount either - about 1.5K.

    You would need to give us more information otherwise we are just guessing.

    One thing to bear in mind is that some payments on termination are taxable, and some are also subject to national insurance. This might include arrears of wages, outstanding holiday pay and payment in lieu of notice (sometimes taxable, sometimes not).

    Or it might just be a genuine error.

  • Well I've found out what payroll had done. They had deleted my salary for November from the total (was made redundant in October) because they thought they'd paid me for that month. They haven't.

    Apparently I will get the money paid back "soon" though I won't be holding my breath. An apology would also have been nice but won't hold my breath for that either.
    (wonders why you are treated like 2nd class citizen after redundancy)

    Thanks for coming back and up-dating us. I'm glad you discovered the error, and hope that it is sorted out quickly.

    Hopefully this next comment is totally irrelevant, but just in case...

    If you don't get this missing money within the next few weeks for some reason, you can make a complaint to an employment tribunal, and this will normally put a rocket up the proverbial. If you need to do this though, you need to be aware that there is a strict three month time limit which runs from the date you should have been paid. As I say, hopefully you will get your money quickly and can ignore my comments.
