Double Wammy from Natwest

I made a claim for my back charges to be reclaimed, and went to the small claims court. However since OFT was taking the banks to court, they held the decision.

3 Years or so since then, is there any chance of me moving forward - as there is another side of the story.

Since as a matter of principle (bad decision) I left Natwest bank, and had left with an overdraft. Cut a long story short, I defaulted however this is now settled back in 2010.

But it is on my credit file, and making me getting an mortgage more complex.

I am not really bothered about the money to claim back, but would be nice, however I would like the default removed. I have read else ware that sending some letters you are able to get the default removed.

I feel that I have been hit twice by the Natwest, and do not know if there are any options available to me.

    The default reflects a factual event. It is not an error (at least on their part - it was on yours). So, it should not be removed.

    Why do you think Natwest should remove it?

  • I do agree with you that the default is an fact, however I did not know if I was able to change the decision. I have read esle were you are able to question for documentation and notification of the default was going to happen. Again this is asking Natwest to prove that they followed the correct procedures.

    Defaults due to banking error can be removed but it is far harder to get defaults due to your error removed. That is exactly what the reporting system is there for. You can ask them and you can push them but I wouldnt get your hopes up.

  • So what are my options with the bank charges, as I did file a court case against the Natwest, but it was but on hold due to the OFT cort case.

    Is this a lame duck now, or can I still progress with the case or make an new claim?

    The postition today is that if the bank wont offer a goodwill refund then you have to pay them or face the consequences.
