Unfair Parking Ticket?

I got a parking ticket from Town and City parking nearly a fortnight ago when I parked at Asda in Livingston. I just forgot to buy a ticket, which is the first time I've ever forgotten. I was going to pay the £40 before the charge increased until I saw this site and realised that its all a big scam.
But, I noticed the part about the "unfair" parking charge. It's my own stupidity that I forgot to buy a ticket. Does that mean I should pay the charge, or is the very fact that there are parking charges at all mean that I should ignore the ticket?

No, no, no, no - don't pay. What is unfair is that Town and Country and the CEO of Asda, Andy Clarke, want to rip off customers. At most you owe them what you should of paid to park NOT £40. Ignore T&C but feel free to send an email to the Andy the scammer : andy.clarke@asda.co.ukAll aboard the Gus Bus !0

Technically, you owe the landowner the fee that you should have paid for the time you parked.
Note the important terms here:
The landowner - this may be Asda, it may be an estate manager. Whoever it is, I'm going to stick my neck out and suggest that it isn't TCP.
The fee you should have paid - The key point. If the fee to park was £1 the landowner can ask for £1 - any demand for 1p more is deemed to be a penalty and is unenforceable in law.Hi, we’ve had to remove your signature. I see. Excellent. I'd willingly pay the landowner the 50p but I was miffed to get a ticket.
This site is very helpful indeed.0 -
Given that ASDA constantly lie about who owns their car parks - they usually claim it is the council in order to sidestep their liability with regards to the actions of their contracted agents, the parking companies - I would be minded to completely ignore them.
That's just me though.Je Suis Cecil.0 -
does your ticket mention anything about the protection of freedoms act, or POPLA?From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0
