advice appreciated - RTA

Hi everyone

I am hoping somebody might be able to offer some advice.

I was knocked over a few days ago in a car park. The car slowed down, I thought it was letting me cross in front of it, but it accelerated and knocked me in the air. I fell on my back on the floor. The ambulance and police attended and I wore a neck brace.
Nothing was broken, just bruises and very sore. I have been to the GP for stronger pain killers and been referred for physio for my neck and shoulders. I have a two week sick note.

People are telling me to put a claim in but I'm not sure there is any case.

    Did you walk into the path of a moving vehicle?

    If so why should you be paid out for something that was your fault?

    No car has any right to accelerate into you. If you believe that he and you had accorded you the right to cross, then he accelerated into you, then something has gone wrong.

    If he should have been able to stop and didn't, he is guilty of careless driving. If you have suffered as a consequence, you have a right to claim. If you walked into his path and he couldn't avoid you, then his culpability is less, but his speed in a car park should be low, and there should be very few circumstances where he shouldn't be able to stop for a pedestrian.

    Dies the driver agree with your version of events?
    Make everything as simple as possible, but not simpler.

    Totally agree with this.
    To be honest, there are not going to be many drivers nowadays who agree with the victim's version of events - even when there are witnesses there.
    The OP should have taken the driver's details (and so should the police). The OP should also check if they have insurance (maybe through house insurance) which provides legal cover.
    I nearly got knocked over on a supermarket pedestrian crossing yesterday - I had just stepped on to it, and the car which was going slowly, just cruised through. I confronted the driver, and they said that I had only just arrived at the crossing.
    We do not know what happened in the OP's case, but as you say Brat, the driver should be going slowly enough to stop, and it sounds as though they speeded up in order to stop someone crossing - something which I have noticed recently.

    Talk to a (some) no win no fee injury solicitors and see what they say.

    Google cashback injury solicitors to find firms who will pay you £100s by way of a fee just for giving them your business (on top of the compensation they win you)

    The driver said she hadn't seen me and the police have agreed it was an accident and aren't taking any further action.

    No criminal action doesn't mean you cannot claim compensation!
