Going To Court Bank And Credit Card

Hi
I sent away on my mums behalf for both her Credit Card and Bank Card charges which both are for the Halifax. I have sent away a few different letters and the responses we received were:
CREDIT CARD: The charges are lawful and you are getting nothing
Bank Account: Please give us 8 weeks to respond
So we went away and told both that we would be takeing them to court if we did not hear anything in 2 weeks. Its been 3 weeks now and we just dont know what to do. It looks like the CREDIT CARD will need to be takeing to court but do we give the BANK CARD another 5 weeks?
The total for these claims are CREDIT CARD £281 and BANK CARD £296
Are you able to go 2 court for claims that amount? Also my mum will not go 2 court so would i be able to defend her in her place? If not what bank reclaim company is best to use?

Firstly, you should stick to your timetable and then proceed to the next stage. You can certainly claim in court for that amount.
It's very unlikely you would have to appear in court, however if you did, the claimant would need to attend unless there are exceptional circumstances.
I wouldn't recommend using any reclaim company. All the resources you need are available here and for free.0 -
Ok thanks, 1 last question. My mum is on benefits and will be for the rest of her life. Would she have to pay the court fee or would this be waived? thnaks0
