DLA and Mobility allowance

Hi all first post so please be kind.
I am looking for help as to where my father-in-law goes next, he has just recently been turned down for DLA and mobility allowance.
His justification for this allowance is: He has chronic renial failure and has to have dyalisis 3 times a week, he has done this for the past 11 years whilst working on a 2 shift pattern ( 2-10 and 10-6) having dyalisis at 7 in the morning ,he has also had 2 unsucessful transplants, he has been told that he will now never get another transplant. He has now had to take redundancy as at 51 years old it is starting to get a lot harder for him.
Somebody has been to assess him ( had a good look at all the mod cons LCD TV, dvd etc etc.....) and they have now come to the conclusion that he isn't eligble.
Any help would be gratefully recieved

Hi 1 st off he needs to appeal , What also helps is having letters from doctors etc to give as edvience , be warned though they are cracking down and its a lot tougher to get dla then a while back ,supose the goverments spending elewhere . best of luck0

The person who assesd him wouldnt be the person to decide if he's eligable or not. that goes to the discision maker... If you feel that yes he is entited ring them now and ask to start an appeals process. this will get the claim looked at again. also get his gp to write a letter regardeng his condition.

He wouldn't have been assessed for DLA on what he has - just his care and mobility needs.
They would have based the decision on reports from his own GP/consultant, and the visit by the EMP.
If he has been turned down for DLA, then you can appeal.
When you recieve the letter from DLA Unit, it will tell you how to appeal.
I would suggest that you contact the CAB and ask for help with the appeal.

You could first ask for a reconsideration. This is where a different decision maker looks at the claim, you can provide addition information at this point you can also request at this point that a doctor comes out and assess him. I did this with my gran who can not walk or care for herself as she was turned down for DLA. We asked for a reconsideration and for her to be assessed by a doctor she was then awarded higher rate care and mob. I also claimed DLA for my disabled son I was turned down and I asked for a reconsideration I provided further letters from the hospital and I completed A week diary noteing down what care I provided how long this took and what it involved. I was awarded Middle rate care for him.
If you still do not have the result you feel is right you have the right to appeal. If you are struggling to do this give your local walfare rights a ring they are great at helping people fight there corner.

As said above, appeal. You need to ask fro a GL24 form. Also ask for a Statement Of Reasons of why your FIL was rejected. They will post these to you. With the SOR, read each one, circle it and then write down why you disagree with this dessision.
Do remember though, that 95% of the time a claim is rejected first time, is because the person who makes the desision, is not, and has not been medically trained, so basicly knows nothing in the medical field.
Remember - DLA care and mobility - its not what help you GET, its what you NEED

Thanks for all the advice, we will know get the ball rolling with an appeal, I already know that his GP and his renal consultant have been in contact with the department that deals with this and they have wrote letters on his behalf.
I think we will ask for the reasons he has been turned down, and work on it from there.
