Claiming bank charges

I have just started the process of reclaiming my bank charges. I've paid my £10 and the bank have written and informed me that it will take approximatley 12 weeks to recieve my statements. However in the closing paragraph they finish up by saying that if they don't here from me within 8 weeks they will assume I will not be proceeding and will close the file.
So if I don't recieve my statements within the 8 weeks and they close the file where does that leave me with the case. I assume that I just carry on reguardless?

If you stated your request as a Subject Access Request for 6 years details under the Data Protection Act then they only have 40 days to supply the data or face complaint to the Information Commissioner. If you didnt state it as such send a covering letter now to clarify your exact intention in request or you will simply end up in their complaints procedure and timescales.

send them a reminder letter a week before the 40 days are up and say if you dont receive your statements you will be reporting them to the information commissioner. If they fail to provide the statements within the 40 days then report them.
If you read the treads on here you will find this is commonplaceyou are working to your timescale not the banks hence the 40 days not 8-12 weeks
