  • Obs had been done as required, no oncoming cars either behind or on the side of road to which I was turning. I apologized because I was in shock, wish I hadn't! I wasn't stationary either. I wasn't turning in to a junction either, was turning right on a main road with no others cars nearby, then suddenly this car hit me.

    So you are saying that the car just appeared??

    I can see why the insurance company are putting the blame on you, if that's what you told them.

    No happy ending for me either I'm afraid, the other driver denied any responsibility and my insurance company paid her claim.

    How many lanes was the road?
    Where was you positioned in the road when you began the u-turn?
    What was the other cars position?

    The only scenario I can think of whereby op wouldn't necessarily be at fault would be if this car was using oncoming traffics lane to overtake - in which case op would still carry a small amount of fault for not checking mirrors.
