PPI Claim against Argos Card Services

Hi. I'm hoping someone out there can give me a bit of guidance.

I'm looking to claim back PPI on an old Argos store card so I wrote to Argos Card Services requesting a copy of my credit agreement using the template letter on this site. I enclosed a cheque for £1 and 4 weeks later they've replied.

However, they haven't sent me a copy of my signed credit agreement. What they have sent me is what they say is a reconstituted copy of my agreement.

The letter says:

"The Consumer Credit (Cancellation Notices and Copies of Documents) Regulations 1983 explains what must be included in the copy agreement. Regulation 3 provides that the copy may omit certain information, including the signature box..."

They have enclosed:

"A copy of the executed agreement as required by s78 (this is a re-constituted copy of your agreement with the signature box omitted as permitted by Regulation 3)."

Can anyone tell me where I go from here.

    Why did you ask for your credit agreement (and yes they are perfectly entitled to send a reconstituted copy)? If anything a SAR (costs £10) would have been better if they gave you the card (and sold you PPI) in an advisory face to face situation.

    If you know you paid PPI then you just need to write to them stating why you were mis-sold.

    What is your reason for mis-selling?
  • I asked for my credit agreement as per the advice on this site. From what I can recall, I didn't ask for it so wanted to check my agreement to see if I'd ticked the box.

    Does the reconstituted copy say anything about PPI?

    If not you can SAR them for all information held about you.
