Is that the case? I thought you were allowed to just drop the overhanging branches back over the fence.
But I would never do this as it is un-neighbourly. I would always dispose of myself if the neighbour didn't want them.

But I think fallen leaves would be different.

There's loads of strange rules to protect people's property. So you can 'trim' overhanging trees, but not if in doing so you'd severely damage the tree. You 'should' offer trimmings back, as they belong to the neighbour, but doubt anybody wants them.

If material falls off, then it's yours, same with fruit, a fallen apple is yours, but technically you can't pick fruit off a branch.

In reality, we all probably just work stuff out with neighbours. I clear our Magnolia leaves from my neighbours garden (before they passed) as they were very elderly. Shot myself in the foot though, as each year I offered to trim the tree back, but they said they liked it too much, so it kept getting bigger, and more leaves!!! Oh well.

I like all the leaves i can get to make compost. I wouldn't normally do this but if the Council are wanting to charge you to take leaves away that aren't even yours...... brush them out into the street and let the Council come to pick them up.
