Were we meant to be charged to go onto a rolling contract?

Having come to the end of a 1 year contract (already resigned once before) so a total of 18 months here we were put on a rolling contract which is fine for us but got charged £55 for the pleasure despite them telling us last time we would only have to pay to resign once in all the time we are here (that previous resigning was £120 for both of us).

I questioned it but got told rather snottily that of course everyone had to pay to resign it was the rules so we paid.

However I keep reading on here that to go on a rolling contract should be free.

Im guessing we cant do anything now but for future reference do you get charged normally?

    Hummm very interesting thanks G__M our rent was also increased grrrr roll on getting our own house and moving out of this money pit paying someone elses mortgage

    What rules? I'd write and ask for a breakdown of what that £55 covered, and then a subsequent letter asking for it to be refunded. They can't just charge you an admin fee for doing no work.

    Have you paid the new rent yet? If you pay it you have accepted it. If you have not received a proper section 13 notice OR there is not something in the AST allowing for a rent increase you don't have to pay.

    AAGGGGGHHHHHHHHhh !!!! just been served our 2 months notice.

    Now im annoyed, I was going to let this fee thing go but not now.

    Is it an actual law they can't charge us to go onto a rolling contract?

    We paid it not knowing it wasn't right but we are still in our original 1 year contract until the 2nd dec when it goes onto a rolling contract.

    we have been served notice today so will have to be out on the 2nd feb.

    I spoke to the letting agent on the phone about the rent increase she asked if i was happy to pay the extra I said no but if I have to to stay then i will. This starts next month.

    No paperwork has been issued for the rolling contract or the rent increase and she says the notice is in the post so I will go with not served until I get it.

    So should we be asking for the fee back and ignoring requests for the rent increase?

    Can they charge us £800 but the new tenants (their mates) lower?

    So much stress :( just hope we get the house we put an offer on this morning so can tell them to stick it a month early grrrr

    Anyone can send anyone else a bill for anything at any time. Whether you have to pay it depends on the circumstances. In this case, you have not received any service in return for the fee so do not have to pay it.

    No. You do not have to be out on 2nd Feb. Read the link I gave you above about how a tenancy can be ended (in this case by the LL).

    1) if you pay it you will have accepted it, and must continue to pay it
    2) if you move to a Periodic Statutory Tenancy you do not have to accept it

    The agents mates or landlords mates? £800 rent or £800 admin fees? If the former in both cases IMO write to the landlord and say you are surprised to receive notice as you believe you have been good tenants. Could be they are telling the landlord you served notice .....

    Yup! Agents don't always tell the LL everything, or tell the truth. They have their own priority (profit) so may not act in the LL's best interests.

    Speak /write direct to the LL.

    Thank you G__M I have read all of your links and no S13 has been issued and its not in the agreement they can put it up by a percentage each year, it was only verbally agreed however now we are being served notice (when it arrives) Im leaning towards not paying the extra rent as notice was served during my original AST and not once the rolling contract started.

    I find it all so confusing, doesnt help having a baby not sleeping ! I just dont want to mess up by trying to stand up for my rights and getting it wrong because I have misunderstood.

    The Landlord is the one who wants his mates in he insisted on showing them around last month :( I was under the impression if we did we could stay longer but this isnt the case now.

    Its the rent that is £800 agency fees would be on top I guess. I thought I had read somewhere that if a landlord served notice for no other reason than they wanted to rent to someone different they had to do it for the same or higher rent but like I say I get things wrong being sleep deprived. Anyway its not an issue really just an added MEH to the whole thing.

    Apologies for all my seemingly already answered questions I really have tried to understand where we stand by reading all the links.
