Lack of work, may be dismissed?

All,

There has recently been a fall in the amount of work we have had and I am seeing people getting made redundant etc. I was absent from work for Monday and Tuesday due to personal issues but they have asked me to attend an employment review meeting tomorrow.

I have been told through the grapevine that there is not much work so they want to sack me to save a wage and need to do it urgently as my contract is about to reach one full year.

Can they do this? I have been absent twice previously. I am just so worried this close to Christmas, I have children and bills.

    Unfortunately they can dismiss you without needing to justify themselves if you have not been there for a year yet. However, they do need to give you your notice term, and if that takes you over the year you have the normal employment protection.

    As you havent been there for a full year they can just let you go but why not see what tomorrow brings with this review. You could polish up your cv and start having a look for jobs tonight.

  • I am 2 weeks from completing a year and my notice period is only one week. Can i put off the employment review for a week then the notice period will take me over that? How long can i put off an employment review?
  • WW - even if you could put off the review - if they think you have taken too much time off they can still dismiss, they just have to go through a process - or they can make you redundant, again they just have to go through a process.

    If they fall for it then yes.

    For the purpose of qualifying for unfair dismissal protection the the statutory minimum notice period of one week counts.

    However under the year they do not even need to conduct the review, they could just issue notice. The do not have to give a reason.

    Redundacy is probably a good option for the employer as long as any selection process would select the OP.
