plus weekly DLA Higher rate

her partner gets incapacity benefit long term of £89.90

this is there only income

I thought incapacity long term is £81.35?

Standard IB might be £81.35, but there are a few extra elements that can be added (mainly age related I think)

    Anyway, for the OP:

Couple allowamce on IS is £92.80, they'd also include a disability premium of £36.00, total £128.80, as their current joint income is £188.35 (excluding DLA which is not counted), they won't qualify for IS.

However they should get Housing Benefit towards their rent, which (assuming their full rent is allowable) would be about £21.75. They might also get something off their council tax too.

Also, and quite importantly, if she's getting DLA Care at the middle or higher rate, it would be worth her partner claiming Carer's Allowance, which would be about £48 a week. Although this would affect HB, which would reduce to about £8 (after taking the Carer's Allownace as income but offsetting a carer premium in their allowed income), they'd be £40 a week better off.
