Decision Time!! Can anyone help?

Hi, I have sent the first two letters to my bank (Barclays). In my second letter i explained that i have been charged an extra 150 pound since my first letter and would 'without prejudice' ignore these latest charges should they pay me the £880 i requested.
I have recieved a letter offering me £590 of the £880 i asked for. I am not happy accepting this as i the real amount i have been charged is almost £1000 pound now in total. I wish to file my claim now at the small claims court, however i am unsure whether i can claim for charges that weren't in my original letter to the bank. Can anybody please help, it would be very much aprecciated.

(P.s I know it may seem a bit arguementative not accepting that offer but these bank charges have caused me a lot of grief, the last year i have struggled to pay loans and credit card bills and have seen my account spiral out of control with 100+ charges each month, not very nice when thats your living money gone for the month!!!! AAAGH they make me so angry!!)

In the moneyclaim you can claim anything up to the date of the claim. Don't let them get away with it and don't you dare have a bad conscience for rejecting their offer! It's your money and you are entitled to it!Reclaimed thanks to this site:

Should i reply to my bank telling them that i do not accept their offer? Plus, as i dont have the 30 or so pound to file the claim at the moment, will i be ok to wait for 1 week, having only just recieved the letter of an offer from the bank?

I have sent three letters to HSBC, I have one response asking for a full itemised breakdown (which I provided immediately). After that I heard nothing so I went ahead and filed my claim with the court through money claim.
I received an acknowledgement within a few days from the court, then yesterday I received an offer from HSBC for £1836.00. My original claim is £2556.33 (including court costs) which is £720.33 less. Also yesterday I received a letter from the court stating HSBC had acknowledged my claim and intended to defend the full amount.
The defence form was completed by a solicitor which worried me slightly
so now im not sure whether to accept their offer (ive already opened a new account) or to keep going.
Can anyone help????

Hi Newno,
Don't accept it, don't let them intimidate you to accept it either. You are entitled to a full refund. HBOS did this to me in December and I didn't accept. However, a month before I am due to go to court they offered me a full refund. So write to them saying that you are entitled to a full refund. In the meantime go to another bank. I am with A&L with whom I am ver happy and I get £25 if I recommend a friend.

know its a long shot but why dont you try ringing them and saying you wont accept anything less than the amount owed and if they dont you will be filing with the courts. Some banks seem to roll over at this and pay up - its all worth a try as it means it would save you hassle of courts and loads of time. If they refuse then your just in original position - if you agree then your quids in and saved loads of hassle0 -

Just thought I'd jump in on this one.
I am claiming £702 from Barclays and I have filed my claim on MCOL (they have until 23rd April to defend, which they probably will), obviously if not I can start the process (judgement I think) and win by default.
In the meantime, I received a letter from Barclays offer £410 which I wasn't happy with. I called them yesterday to advise that I have started the court process, but would stop it if they offered £630 (charges + court fee). They declined and wouldn't budge.
I therefore said that I would be continuing with the court process as necessary, the lady said OK and she would note my file accordingly.
Don't let them put you off. I'm still hoping they'll come back with another offer soon!

Im with barclays too, and have got to stage where Theyve offered me a gesture of goodwill of £1800. Im trying to claim £2800. I intend to write back and refuse the offer, but it's scary the thot of starting MCOL. Is it easy to do. I was hoping it wouldn't get this far. When i send my letter saying i refuse their offer do i immediately start MCOL? or do i give the bank a week? hope you can help.

Yes MCOL is easy, but obviously there is a cost involved in doing this (this varies depending on what you are claiming), but you can claim this back in the process.
I wouldn't give them a week as personally they will not budge on their offer so you may as well get things started.
I was hoping it wouldn't get this far too, but reading the other threads there's hope for us all!
