Refund question, sorry if this is in wrong thread

Sorry if this is in the wrong place just looking for some advice.

Can anyone tell me what the rules are regarding refunds please. Problem I have is that shop is saying yes they will refund me my money but they will only do this via credit card or cheque. Think I paid credit card for purchase but they want to pay cheque.

Now the sting in the tale for me is that they will take 10 working days to release the cheque and then they want to uplift the suite and give me the cheque. Now if cheque is english I could be looking at 8 working days with bank of scotland and 6 working days if its scottish. This could mean more than 3.5 weeks with no money and no suite to use / buy.

They are saying at the moment that it is reids company policy to do this but surely I should not be expected to hand over goods and not have cash in hand?

Can anyone point me to a link or regulation that says yes they can do this to me or no they cant do this please. I just cant believe I am expected to be left in situation that they can uplift suite present me with a cheque and have to wait in effect 2 weeks for that cheque to clear and after that 2 week period then begin hunt for new suite ?

Thanks in advance

When I worked in a shop the rules on refunds were,
paid in cash refund in cash
paid by debit card refund on debit card.
paid by credit card refund on credit card.
paid by cheque that's when it used to get tricky, if it was a while ago refund in cash.
if it was a few days ago (ie cheque still had time to bounce) it wasup to managers discretion what they did.
I actually thought it was against credit cards T&c to refund you in anyway other than on credit card. Have you rung cc company to ask what their policy is?
  • Thanks spendless for reply. In regards to your question about cc things get a bit tricky here.

Card belongs to my mum. She did not want the money to go on her cc as she does not want 1 grand sitting in her cc account with her not being able to touch it.

The above said store dont know that my mum does not want paid back into her cc. The only option given to me at moment is by cheque by reids furniture.

To cut a long story short about 1 month ago they offered me refund or more accurately they were forcing refund upon me. After I fought with them for a while they offered to order suite for me but last week I recieved news that the suite was no longer being made and I had option again of refund or pick another suite. Tried to pick another suite but prices had gone up £200 on same type of suite with same colour and same promotion just made by different manufacturer. So they were going to make me pay the £200 of a difference so I said to them this morning I wanted refund.

This is when they said they will come to door and hand me cheque and uplift suite. Like I said earlier though this means I have to wait 2 weeks for cheque to clear before I have access to go and buy anything and they have the suite and they could easily cancel cheque in that time period. A company size of reid furniture is not likely to do this but you never know.

They are stating "the company policy is to issue cheque which takes 10 working days and will be delivered upon uplift of suite" no matter what I say they repeat that line. I thought I had the right to cash refund?

I just wondered if there was a line somewhere in refund law I could quote to them that would make them either give me a bankers draft or cash or let them give me the cheque but they could not uplift until money cleared my account?

i don't think there is, think you may just have to go with it. :( had a similar problem with a fridge freezer, took 8 days to clear in bank (10 if you count the fact i got the cheque on a saturday), i'd paid by cheque though so didn't have much choice.
