  • No the complaint has not been rejected the lender has refused to provide its final response to the matter thats the difference FOS have asked them to do so and for me to get back to them. However due to the fact that its the ICO who deal with fraud i am having to wait for them to finish there investigation as the independent assessor on the 18th July 2012 informed yes after three years that they do not handle fraud. THe lender has through or at the hand of its advisor committed a fraud that is beyond doubt, they have also by its failure to adhere to FSA rules governing MCOB been in breach of the mortgage contract I have with them. Pity for this lender that I've not rolled over and given up as they were expecting or now wished. Hey ho.

    Exactly right it does not make any sense, and who would have thought a bank manipulating anything at all for its own advantage....

    Oh Maybe that was just a figment of my over active imagination.

  • By the way i have received an offer of compensation, but until this matter is correctly investigated thats what it will stay just an offer i returned the payment.

    As the payment was sent to you without your first signing an acceptance for this offer, this will be as said a small token payment. Often referred to as a go away payment.

    Do you read some of the complete nonsense that you post. You keep contradicting yourself and adding things, what is the point of your thread.

    What fraud do you think has occurred ?

    You do realise that you have made no loss and therefore have no claim.

    You have been declined a mortgage that you applied for. Unfortunate but a fact of life, you have no entitlement to a mortgage and the lender is under no obligation to lend you any money.

    I could be wrong but my understanding is that the ICO does not investigate fraud. The ICO investigates breaches of the Data Protection Act etc..

    The bank is gaining nothing. Even your mortgage deal is costing them money.

    I suspect they would happily lose something though.

    Costing them money the deal I'm on at 0.84pc as in there losing out and the fact that because i could reduce balance and term by a decade or more in one hit, yeah they be really up for me walking away with practically an interest free repayment term rather than making the usual wack.
    Unfortunately they not lost me yet neither have they repossessed my home or forced me to another lender.

    Thats exactly why they never recorded a full application for credit as if they had they realised i could not get the loan from any other lender which would have defeated there objective.

    Some body asked what fraud had been committed, let me ask this ... if a bank says that they have conducted assessed something for you and they actually have not then, once they have checked their data systems to see if they have actually carried out what they have claimed they had done, as they happened to do on the 22nd NOV 2009 and data and privacy confirm that they had not done what they claimed in a written statement,before there inaccurate statement becomes a fraud they can either correct the statement and apologise and compensate, or they can do nothing allow inaccurate disclosure to a third party at which point it becomes a fraud, with the intent to cause loss in the hope that the customer gives up and gets lost.

    There are three main types of fraud , fraud with intent, fraud by neglect(i.e. they should know better) and fraud by omission,,,,, take your pic make my day.
