The Firm can not refuse to provide a final response to your complaint, having reviewed all material evidence in the case. They either uphold or reject. If the investigation exceeds 8 weeeks, FOS can interject and make a decision on their behalf, which at a term of 3 yrs plus, would most definately have happened.
So the fact you say FOS are waiting and continue to wait, for over 3 yrs, for a final resopnse from the firm (who refuse to give one), before they will act, is also I would suggest not factual.
Its not that its too complex for us to understand, it is the fact that your postings are not coherant, structured or largely understandible in their format or content ... with varying degress of the story revealled or removed at every turn.
If I were you, leave this for your cited law firm in Manchester to deal with, after all you are paying them from the privildge (I also don't think they would be too happy if they knew you were publishing this on a free forum and seeking advice supplementary to theirs, from unconnected parties).

You are right holly they have no right to refuse a response however this is what has happened FOS have been unable to handle this case from the begging and as per the email i posted from them on fri unable to provide an answer have past it further up the chain of command which I await the response the Independent assessor is awaiting for the matter to be responded to before she considers the case.
Yes maybe it was mistake in posting on the forum however this is a matter which will ultimately have repercussions for all mortgage holders with this lender.
I am not prepared to accept a non answer from this company, i hope you understand just a little why i am doing this for my own reasons.

And just post up what eventually transpires .... after all you're not getting the responses you want here, so I feel there is little to be gained in continuing the discussion.
Wish you well in any event, and ask that you post up the genuine findings of the bank and FOS and the anticipated court case from your legal team when the time comes.

So OP is unhappy they gave him a mortgage which is now 0.84% tracker and is having a general moan up.
And furthermore the lender will now not allow the OP to port it!
Suspect that the complaint made a few years back has backfired in a big way......
So only recourse for the OP is to complain and complain and complain.

There are something here that don't quite ring true
If the bank does not reply to the fos etc, the FOS will inform the bank that it will make a determination upon the evidence that it has received.
The Independent Assessor (that is if you not in fact mean Adjudicator) only deals with service complaints about the FOS and have no powers authority in terms of actual bank complaints.
So are you also complaining about the FOS ?0 -
Could you please actually explain what your complaint is and what is the out come your are looking for, as your posts don't make a lot of sense.
If sounds like you applied and got a self cert, you did some work on the property and increased its value and then you tried to remortgage, I can only guess for a higher amount, based upon the increased value of the property and you were turned down as you could not afford it.0 -
