I don't think the OP is disputing that they owe the money. Its attractive to think about not paying back some debt but if it was me I'd want to do the right thing and pay back what I knew I owed, for my pride and conscience. It is everyone's decision to make obviously but I can't help disagreeing with such tactics.

It IS quite important and, I believe, moral to look at reclaiming those penalty charges that are illegal, and the initial steps are the same.

  • I'm with the CCCS, the are very re assuring and professional.
They sent my an information pack with letters to send to your creditors, it also helps you budget, and yousend this budget to your creditors to show them how much you could afford.
At the time I could only afford to pay the minimum ie £1 a month to each creditor, I had 6 different debts at the time totalling £20000  , thus the interest on this was hefty, CCCS also get the creditors to freeze any interest, therefore the debts are only ever reducing.
The creditors will accept this if you stick to your guns, some will transfer the debt to agencies, but again stick to your guns and send them your budget, only pay what you can realistically afford. Don't let them bully you.
As you can see from my debts it will take me well over 100 years to pay off at this rate.
However, I'm now earning more but rather than pay off the debts I have an ISA and all my spare money goes into that, hopefully i'll save quicker than i can pay off, interest rates permitting. I currently have £4000+ in my ISA, in 12 months. Hopefully debt free in 3 years.

    Hope this helps

I'm not disagreeing... I'm all for people reclaiming their bank charges. From what I know though its not too similar, bailiffchaser is advocating denying a debt and hoping that the creditor can't prove it. Bank charges reclaims are on the basis that the charges are punitive rather than representative of the actual cost to the bank. But lets not get into that debate.... ;) Its very much possible to be in favour of reclaiming charges and against trying to run away from responsabilities.

  • Hi and thankyou for your replies, I have just had my interview with CCCS and they were fantastic I cant wait for my forms to come so I can get started.
I will be paying £250 per month for just over 4 years to pay back my £13K debt, I know it will be tough with the nasty phone calls etc, I am very worried that they may call me at work! but I will just have to explain it to my boss if thay happens,
I feel so much better than I did yesterday, so glad I never sent my forms off to the other company that took 15% of my monthly payments.
I will keep you posted. thanks again xx

    thats great to hear!!
if they call you at work refuset o take their call and say that you will speak to them at home. TBH though we never got very many as most of the companies realise that if you are with CCCS than you really do have money probs and will leave you alone!!
Best of luck.. remember we are all here to have a whinge at and celebrate successes as well!!

    Hi,

Welcome to this most fantastic of sites!! I just wanted to add I really do not know where i would be without cccs, I am on month 2 of my dmp and they have been fantastic. I rang them in tears on Monday as I had a run in with a boy from Nationwide trying to bully me, but cccs were great and told me to take no notice. It really helps when your back is against the wall.

  • Got my forms today, I have missed the payment date for this month so they have told me to send £10 to each of my creditors with the letter they have given me to explain the situation,
That means I will have a little extra cash this month, might be able to get my phone back on, I owe bt £180 (not my fault) we had a family relative staying for a while who ran up this huge bill then made no attempt to pay it back.
Any way thanks guys for your help Im so glad I found this site and CCCS.
  • I recently signed up with CCCS.
£39,000 in 6 years is my forcast.

Why is it that some institutions are quick to sort things and some are pathetically slow.
It is weeks since I received notification from MBNA and First Direct that they acknowledge the Debt Management Plan.

Egg and Mint (Royal Bank of Scotland) keep sending me Default Notices, Barclaybank have just said they are passing the debt on, no mention of the DMP, but Barclaycard, nothing from them whatsoever! They will have received the offer from CCCS by now, indeed the first payment has been acknowledged by MBNA.

  • Only just sent my forms back on friday and already getting phone calls from the bank at work they left a message on the voicemail, not a nasty one yet.
I dont think they will know about my dmp yet but I have just cancelled my direct debit for my loan to them so they will be wanting to know why,
I hope they dont ring at work again I have heard lloydstsb are the worst though.
Apart from that im feeling very positive ive been sleeping like a baby for the last few nights.
