I have just got back my ESA85 and it recommends me being in the support group medium term.
I've not work for over 5 years, and I live with a partner, how would that affect me!?0 -

If you are on contributions based ESA, your payments will continue.
Else, they will be affected by their income, probably wiped out, as your household income exceeds your ESA.0 -

Were you being transferred from Incapacity Benefit to ESA or was this a straightforward new claim for ESA?
Just thinking this must be a transfer over because if you haven't been working for 5 years then you wouldn't have been entitled to contribution based ESA in the first place (and therefore wouldn't be going through the ESA process.)
Or am I wrong and missing something?0 -

No.
IB is a contributions based benefit.
You were presumably working in 1999/2000 2000/2001 before claiming, so you were put onto IB, not IS. Because you have been ill continuously, a claim for ESA is assessed on those tax years.
IB claimants transferring over to ESA go onto contribution based ESA for at least one year, though this time limit does not apply if they are placed in the support group.
Your payments will continue, and if the ESA-conts amount is lower than the IB payment, you will be entitled to transitional protection until the ESA rate catches up.0 -

You were on IB so you will get ESA C (SG) for as long as you remain in the SG. You will be reassesed eventually and could either fail or go to WRAG.
OP, March 2012, you need to give more info,
Are you on another benefit and being changed to ESA or will this be a new claim for ESA? What were you doing before....working? partner works how many hours?0
