That was me making a false assumption of what the finance clerk meant when she said the debt would be charged to the estate.
I would guess she meant the estate would be billed .but wrong about the legal charge.
A charging order could be applied for but it would have to be through the county court.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -

If you've had the property on the market for 3 months and only had one viewing, doesn't that scream at you (and your sister) that the price is way too high? Given that people routinely view properties priced at more than 10% of their budget (to allow for offers), it does sound, I'm afraid, as if your price is way off the mark.
The fact that your EA hasn't been in touch also rings alarm bells - it sounds as if they've put it on at a high price to get your business but know that you'll get nothing like the current price. At the very least, why not go back to the Housing Board and ask for further advice on there?
It screams that to me - but to dad and sister it screams that I got probate sorted at the wrong time. If I'd done it early enough they could have put the house on the market earler. August is far too late to put it on the market as no-one looks at houses then, they just leave it till April...
I'll try and ask on the Housing board, but I'm not sure how much help they can give without details like the name of the village, which I don't really want to give.If you aren't hearing from the EA bin them, a good EA should keep in touch and have an idea why you aren't getting viewings/offers.
I agree with you and Dunroamin about the EA. When my dad tried to sell his house with them (he wanted to buy this one) they wouldn't even do viewings, he had to do them. He missed out on lots of viewings because he was at work when they wanted to come.
They are the EA who gave the highest valuation, I thought we should have gone with a mid priced one who was local rather than national, but because it had to be done quickly it was my sister who chose and got it sorted.
They haven't been in touch apart from after the woman looked, saying that she really liked it but had a few worries about work that needed doing.
It's still (or was a few weeks ago) prominent in their window though.Unless I say otherwise 'you' means the general you not you specifically.0
