I am currently claiming back my bank charges from Barclays Bank.
I went through MCOL and they Acknowledged my claim giving them the 28 days. It was the 28th day last Saturday 15th, of course being a Saturday they get an extra working day.
So I checked MCOL early this morning and entered Judgement by default. I filled out the form for that online and was waiting for it to be sent for approval etc. I have just checked on it now and it says they have put a defence in!!
How can they do this?? for 1. after their 28 day deadline?? and 2. After I have asked for Judgement by default??
I'm really confused over this now. If it goes to my local court how long will this take? and do I have to pay for the Allocation form?? I'm relying on this money to come quick so we can pay the fee to MCOL for my partners claim from Lloyds.
Any help would be greatly appreciated,
Natalie

They either filed at the last minute or have been given some leniancy by the court. Either way it's typical of the banks behaviour in these cases. They are showing contempt for the court process and hopefully more judges will start striking out their defences as an abuse of process.0 -
they will put in a defence hoping we will cave in, stick with it ,banks have no defence and they know it , just hold strong0

I had the same done to me with Natwest. If you check with MCOL it does state that the bank can enter defence until you press the Judgement button, so for instance if you where due to do this on 28th and fogot and they filed defence on 1st, there is nothing you can do. Unfortunately because it was a weekend this method applies. I had to phone the court to find this out as it really P****d me off, as i am sure it did you.:rotfl:
