warranty

i bought an item from ebay 29/07/2011 that has now failed the seller lists a 2 year manufacturer warranty in there listing and in there returns policy they have wrote

Manufacturers fault Buyer takes no longer than 14 days, for items which have failed during normal use, due to a manufacturers fault. Buyer understand that a suitable replacement item may be any item which has similar design and functional features.

can i send it back for replacement?

    Not if it has a valid manufacturers warranty.
    In this instance you can normally deal directly with the manufacturer providing that you have proof of purchase and you followed any requirements (such as registering the warranty) when you made the purchase.

    A couple of things to bear in mind is that not all ebay sellers are 100% honest with what they state on their listings and
    many manufacturers will only honour their warranties if the goods in question were sold by an approved retailer.

    All you can do at the moment is to contact the manufacturer and see what they say.
