Dispute opened what happens now?

I opened a dispute as the item I received was SNAD - I had already contacted the seller but they refused to refund and told me to resell it if I wasnt happy.
The dispute was opened yesterday and the seller has today sent me another email refusing the refund and telling me again to resell if I'm not happy. I have replied saying why I think it is SNAD and asking once again for a refund.
It now seems as if its going to be a tennis game as I'm not giving in and it doesnt look like the seller will either. What happens if we cant agree? I just want to send the awful thing back and recoup some of my money. To make matters worse I guess I will be down on the return postage as its a huge box weighing over 10kg.
I did notice that the seller has until the 26th (I think) to respond does this mean that we have until the 26th to reach a solution and if nothing is reached I then have to do something else?

I assume this is an eBay case and not a Paypal one.
You have to wait the 8 days (26th). If the seller doesn't respond (which he has), or if the seller responds but you still can't work things out after the 8 day period, go to the Resolution Centre to escalate the case to Customer Support to make a decision.
If it goes in your favour, you will be told to return it tracked for a refund.

Thank you for your help it is really appreciated - you are correct it is an ebay case.
At the moment the ball is once again back with them. They have said sorry sort of and admitted bits are missing but still refuse to refund - keep telling me to sell it! Bin it more like!0 -

It can seem like tennis at times. To be honest there can be more gained by not replying to every message IMHO, let them sweat it out. You have had your say, unless they come up something new then I would leave the messages at that and escalate on the 8th day.
To escalate, it will be just after the time you opened the case - 8 days later (say you opened it at 5pm, then you should be able to escalate it at 5pm on the 8th day).0 -
Thank you I will take your advice and not reply to the next email from them. Its put me off buying for a bit so I've spent the last few hours listing stuff I had better work out how to block them as a bidder.0
