hard drive bought on ebay - different model delivered

I have bought a SSD hard disk on ebay using paypal payment (buy it now)
The guy said it was used but barely for only a fortnight.
It has arrived and doesn't look very new, there are some marks on it and also the model number does not match the description/title.
The item is generally the same as the one listed but specific model number is different.
I would like to return the item because I was specifically looking for this particular model. The listing said "returns accepted" but this is a private seller so I don't think distance selling applies.
I have opened a Returns case and awaiting seller to respond. However, I am wondering if this is safe because they are private seller.
Am I better off filing an Item not as described case and then should I be waiting for ebay to instruct me to return the item instead?
Does a different model number constitute item not as described?

Is it definitely a different item? Some products use different model numbers in different countries. If the seller offers returns and hasn't added any awkward conditions, I don't see any problem with using this process, but you will have to pay the return postage, which should be recorded.0

yes its definitely different, the manufacturer website has two different datasheets for each.
i suppose my question is, if the seller agrees refund, i return and then doesnt issue refund, am i guaranteed the money back from ebay providing i can prove postage?0 -

i opened a snad case instead and seller has replied saying to post back for full refund.
ebay have said to ensure tracking and that the seller signs for delivery.
what happens if another person in the household signs (with a different name?) does it still count as proof?0 -

It only has to show as delivered (or attempted delivery).0 -
Is he really a private seller? Selling lots of broken computer parts?

Interesting you say that because in the last twelve months he has sold around 12 items, all computer parts like the ones I have bought.0
