How to take bank to the county court?

A friend of mine recently started court procedings using moneyclaim, but has since been told they cannot do anymore to help and that he should go to the county court, I think he applied for about £1500 worth of bank charges from Lloyds TSB.

I to have bank charges of £870 to claim back from Loyds TSB, and have sent the 2nd letter with no reply, but at present i do not have the £80 that i need to pay moneyclaim to get the ball rolling. My friend told me i should go straight to the county court and as i am a single mother on income support i will not have to pay as i am enititled to legal aid.

Does anyone know anything about this sort of procedure? do i get in touch with a solicitor? or do i go into the court rooms and ask to speak to someone there? i have no idea how to start procedings off.

When you use MCOL, the case is first dealt with at Northampton. If a defence is filed it is usually transferred to the plantiffs local county court. This is probably what your friend means.

You can either use MCOL or file the claim straight with the County Court in person. Either way, you shouldn't need a solicitor as the details you need for the forms are available on this site.

You do not have to pay court costs if you are on benefits, but can't file the claim online then. You have to go to your local court with the proof of why you are excempt from paying and fill the forms in they give you.
